Amitabh Bachchan wins temporary personal protection order

Bollywood legend and veteran actor Amitabh Bachchan filed a case in the Delhi High Court seeking protection of the rights of his personality, image, voice or any of his characteristics without his consent, after which the court issued a unilateral interim order in his favour.

Prominent Advocate Harish Salvi along with Amit Naik and Praveen Anand, under the guidance of Anand and Naik, appeared before Bachchan in the High Court. The matter was heard before Judge Naveen Chawla.

Salve recognized that there is a complete misuse of Amitabh Bachchanname, image, voice or any of its characteristics without his consent.

Misuse of his name, image and voice, especially by mobile application developers, and people who run sweepstakes by illegally associating with KBCBook publishers, T-shirt sellers and various other businesses have led Mr. Amitabh Bachchan to approach the Supreme Court seeking a restraining order against the use of his personality traits.”

Amitabh Bachchan’s lawyer also informed the Delhi High Court that the alleged offenders had illegally registered Bachchan’s name as web domain names such as www.amitabhbachchan.com and www.amitabhbachchan.in.

Delhi High Court Judge Naveen Chawla noted that Plaintiff Amitabh Bachchan alleges violation of his right to publicity as a celebrity.

The Court further noted that it could not be seriously challenged that the plaintiff is a well-known personality and is harmed by the use of his name, voice image, etc. without his consent.

The Judge HC said, “I am of the opinion that the plaintiff was able to bring a prima facie case in his favour. It appears that the defendants are using the celebrity status without his permission, permission and consent.”

Judge Naveen Chawla in his interim order issued an ex parte temporary injunction in favor of the plaintiff / Amitabh Bachchan and against the accused.

The petition stated that there was an infringement of the plaintiff’s personality through various methods such as digital means and instant messaging applicationsmaterial means, and so on.

Digital means include many websites and cell phone Applications that have been found misappropriating the plaintiff’s photos and/or other properties, to create popularity among the public and to entice members of the public to download these mobile applications.

IM applications include several unscrupulous parties found using Bachchan’s image along with his name, and a representation of TV show Kaun Banega Crorepati (associated with Bachchan), to trick the public into believing that Kaun Banega Crorepati is offering lottery prizes to members of the public.

Physical means include cases where fraudulent dealers install actor’s photos and posters on their premises, on billboards or even on products they are involved in manufacturing and selling, with the intention of illegally demonstrating relationship/affiliation/sponsorship/cooperation with the plaintiff to increase their illegitimate profits.
