On December 10, before the election, the IOA will certify the incorporation of Olympians of Distinguished Merit (SOMs) into the General Assembly. The SOMs will be selected by the newly elected IOA Athlete Committee. The results will be announced on the same day as the election.
The IOA on November 10 adopted its draft constitution drafted under the supervision of the Supreme Court and the International Olympic Committee (IOC), but many members said they were forced to do so after the Supreme Court made it mandatory.
During the special meeting of the IOA plenary, some members raised objections to at least six amendments contained in the draft constitution, and said, “The democratic rights of the plenary have been completely abolished.”
Faced with the threat of suspension from the IOC if elections are not held by December, along with directives from the Supreme Court, the IOA had no other alternative but to make changes to its constitution.
The draft constitution was prepared by retired Supreme Court Justice L Nageswara Rao appointed by the Supreme Committee and the IOC has already given its approval. The Supreme Committee agreed to hold the IOA elections on December 10th.
On Tuesday, the Supreme Court directed that its previous orders on adopting a new constitution and balloting to elect an executive committee for the IOA must be strictly followed.
The panel of Justices D. Y. Chandrachod and Justices Hema Kohli and J. P. Pardiwala recorded the submission of Solicitor General Tushar Mehta, appearing to the Centre, that the IOA Constitution, as drafted by Justice (ret.) L. N. Rao, was adopted at the Annual General Meeting (AGM) of the Indian Olympic Authority and any Amendments to it will only be made with the express permission of the court.
The draft constitution provides for equal representation of male and female members in the IOA General Assembly which will consist of two representatives each – a man and a woman – from the National Federations whose sports are included in the Olympiad/Asian/Commonwealth programme. Games, the members of the International Olympic Committee of India, two representatives of the Athletes Committee – one man and one woman – and eight representatives – four men and four females – are Distinguished Olympians (SOM). Each member will have one vote.
The IOA elections were scheduled to take place in December last year but could not be held due to a pending case in the Delhi High Court in which a petition was filed, for an amendment in its constitution before the elections were held to align it with the National sports code.
